Terms of Service

Welcome to My Learning Buddy. These Terms of Service ("Terms") govern your access to and use of the myLB mobile application and related services.

By creating an account, accessing, or using myLB, you agree to these Terms. If you do not agree with these Terms, please do not use the service.

1. About myLB

myLB is an AI-powered learning application designed to help users organize study materials, create study sets and flashcards, visualize concepts, practice active learning, plan study sessions, receive educational assistance, and participate in gamified and collaborative learning experiences.

Features may include study sets, flashcards, the Infinite Canvas, Feynman Mode, AI Study Plans, AI Solve, Focus Pets, achievements, analytics, Co-op Quests, group challenges, shared progress, and Group Relics.

We may add, modify, improve, suspend, or remove features from myLB from time to time.

2. Eligibility

myLB is intended for users aged 13 and older. You must be at least 13 years old to create an account or use myLB.

If you are between 13 and 18 (or the age of legal majority where you live), you may use myLB only with the involvement of a parent or legal guardian, and we may require evidence of parental consent where required by applicable law.

By using myLB, you represent and warrant that:

• You meet the minimum age requirement of 13.
• You are legally capable of entering into these Terms, or a parent or legal guardian has consented on your behalf where required.
• If you are using myLB on behalf of another person, organisation, school, company, or other entity, you have the authority to accept these Terms on their behalf.

We do not knowingly permit children under 13 to create accounts or use myLB. If we learn that a user is under 13, we will take steps to close the account and delete associated personal information.

3. Accounts

Certain features of myLB may require you to create an account.

You are responsible for:

• Providing accurate account information.
• Keeping your login credentials secure.
• Maintaining the confidentiality of your account.
• All activity that occurs through your account.
• Notifying us if you believe your account has been compromised.

You must not use another person's account without appropriate authorization.

4. Your Study Content

You may provide content to myLB, including notes, study materials, questions, flashcards, mind maps, explanations, voice input, images, and other educational content ("User Content").

You retain ownership of your User Content, subject to the rights and permissions necessary for myLB to provide its services.

By submitting User Content to myLB, you grant us a limited, non-exclusive permission to host, process, reproduce, transmit, and otherwise use that content as reasonably necessary to operate and provide the features you request.

This may include processing your content through our third-party AI service providers when necessary to provide AI-powered functionality.

You are responsible for ensuring that you have the necessary rights to submit any content you upload or provide to myLB.

5. Artificial Intelligence Features

myLB uses artificial intelligence to provide features including Feynman Mode, study-set generation, mind maps, AI Study Plans, AI Solve, and other learning assistance.

AI-generated information is provided for educational and informational purposes. It is not a substitute for professional advice, including medical, legal, financial, or other professional advice.

AI Solve and other educational assistance features are intended to support learning and understanding. We do not guarantee that generated solutions, explanations, answers, calculations, or recommendations will always be correct.

You are responsible for reviewing AI-generated content before relying on it, submitting it as academic work, or using it for important decisions.

6. DeepSeek and Third-Party AI Services

myLB currently uses DeepSeek as a third-party AI service provider. DeepSeek processes data in the People's Republic of China.

Depending on the feature you use, information and User Content may be transmitted to DeepSeek for processing in order to generate the AI response or functionality requested by you.

Your use of AI-powered features is also subject to any applicable terms and policies of the relevant third-party services.

Our AI provider's terms permit it to use submitted content to develop and improve its technology, including training its machine learning models. Do not submit highly sensitive personal information, or content you are not comfortable with being used in this way, into AI prompts or study materials unless it is necessary for your use of the feature.

7. Acceptable Use

You agree to use myLB responsibly and only for lawful purposes.

You must not:

• Use myLB to violate applicable laws or regulations.
• Attempt to gain unauthorized access to another user's account or information.
• Interfere with, disrupt, or damage the service, servers, networks, or infrastructure supporting myLB.
• Introduce malware, viruses, malicious code, or other harmful material.
• Attempt to reverse engineer, decompile, or otherwise extract source code from the application except where permitted by applicable law.
• Use automated systems to abuse, overload, scrape, or improperly access the service.
• Impersonate another person or misrepresent your identity.
• Use myLB to harass, threaten, abuse, or harm other users.
• Upload content that you do not have the right to use.
• Attempt to exploit or manipulate XP, badges, Focus Pet progression, Co-op Quests, Group Relics, or other gamification systems unfairly.

8. Academic Integrity

myLB provides educational tools intended to help users learn and understand material.

You are responsible for following the academic integrity rules, policies, and requirements of your school, university, instructor, examination provider, employer, or other applicable institution.

We do not guarantee that use of AI Solve, Feynman Mode, study generation, or any other myLB feature will be permitted in a particular academic setting.

You should determine whether and how AI-assisted tools may be used for your particular assignment, examination, or course.

9. Focus Pets, XP, Badges, and Virtual Features

myLB may include virtual and gamified features such as Focus Pets, XP, pet evolution, achievements, badges, Trophy Rooms, Group Relics, and other digital rewards.

These features are provided for entertainment, motivation, and engagement with the learning experience.

Unless expressly stated otherwise, virtual items, XP, badges, pets, relics, achievements, and similar features:

• Have no cash value.
• Cannot be exchanged for money.
• Cannot be transferred outside myLB.
• Do not represent ownership of real-world property.

We may modify, rebalance, remove, or reset gamification features when reasonably necessary to maintain or improve the service.

10. Multiplayer and Co-op Features

myLB may provide multiplayer features such as lobbies, Co-op Quests, group challenges, shared progress, and Group Relics.

When participating in collaborative features, you agree to communicate respectfully and comply with these Terms.

We may remove content, restrict participation, suspend accounts, or take other appropriate action when users abuse multiplayer features or violate these Terms.

We do not guarantee that multiplayer features will always be available or that group progress will never be affected by technical issues, maintenance, or changes to the service.

11. Intellectual Property

The myLB application, including its software, design, branding, logos, graphics, interfaces, original text, features, and other materials provided by us, is owned by or licensed to myLB and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on myLB or its proprietary materials.

These Terms do not transfer ownership of myLB or its intellectual property to you.

12. Third-Party Services

myLB may depend on or integrate with third-party services, platforms, infrastructure providers, AI providers, authentication services, analytics providers, app stores, or other third parties.

Third-party services may have their own terms and privacy policies. Your use of those services may be subject to those additional terms.

We are not responsible for the availability, security, policies, or practices of third-party services that we do not control.

13. Availability and Changes to myLB

We work to keep myLB available and reliable, but we do not guarantee that the application or any particular feature will always be available, uninterrupted, error-free, or secure.

We may perform maintenance, updates, modifications, upgrades, or other changes that temporarily affect availability.

We may add, change, suspend, or discontinue features at any time when reasonably necessary.

14. Account Suspension and Termination

You may stop using myLB at any time, and you may delete your account from within the app (see Section 15).

We may suspend or terminate your account or restrict access to some or all features if we reasonably believe that you:

• Violated these Terms.
• Used the service unlawfully or abusively.
• Created a security or safety risk.
• Attempted to manipulate or exploit the service.
• Engaged in conduct that could harm myLB or its users.

Where appropriate, we may provide notice before taking action, but immediate action may be necessary in cases involving security, abuse, fraud, or legal requirements.

15. Account Deletion

You may delete your myLB account at any time directly within the application by going to Settings → Account → Delete Account.

When you delete your account:

• Your account will be deactivated immediately and you will be signed out of all devices.
• Your account information, study content, and learning data will be deleted within 30 days.
• Data held in encrypted backups will be overwritten within 90 days in the normal course of operations.
• We will retain only information we are legally required or permitted to retain.

You may also request deletion by emailing mylearningb@gmail.com . Full details of what is deleted and when are set out in our Privacy Policy .

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, myLB is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The service will always be available.
• The service will be completely error-free.
• AI-generated information will always be accurate.
• Study plans will produce a particular academic result.
• AI Solve will always provide correct solutions.
• Feynman Mode will accurately determine your level of mastery.
• Your learning outcomes will meet a particular goal or expectation.

You use myLB at your own discretion and risk.

17. Limitation of Liability

To the maximum extent permitted by applicable law, myLB and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the service.

This may include loss of data, loss of profits, loss of academic opportunities, interruption of studies, or other indirect losses.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless myLB and its owners, operators, affiliates, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms.
• Your unlawful use of the service.
• Your User Content.
• Your violation of another person's rights.
• Your misuse of AI-generated content or myLB features.

19. Privacy

Your use of myLB is also governed by our Privacy Policy .

The Privacy Policy explains how we collect, use, disclose, retain, and protect information associated with your use of myLB.

20. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the application, our website, email, or other reasonable means where appropriate.

Your continued use of myLB after updated Terms become effective means that you accept the revised Terms, to the extent permitted by applicable law.

21. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

Subject to the paragraph below, the courts of Nigeria shall have jurisdiction over any dispute arising from these Terms or your use of myLB.

Nothing in this section excludes or limits any mandatory rights you may have under the consumer protection, data protection, or other laws of your country of residence. If you are a consumer resident in a jurisdiction whose law grants you a non-waivable right to bring proceedings in your local courts, or to benefit from mandatory local consumer protections, that right is preserved. This includes consumers resident in the European Union, the United Kingdom, and other jurisdictions with comparable mandatory protections.

Before commencing formal proceedings, you agree to contact us at mylearningb@gmail.com so that we can attempt to resolve the matter informally. This does not prevent either party from seeking urgent relief where necessary.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.

23. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly incorporated by reference, constitute the agreement between you and myLB regarding your use of the service.
